INITIAL CONVERSATION

We search the Trade Marks Registry to identify any existing or pending marks that may conflict with yours. You receive an honest read on availability — clear, risky, or likely to face objection — before you commit to filing.

CLASS IDENTIFICATION AND DOCUMENTATION
We identify the appropriate Nice classification for your business activity, prepare Form TM-A and Form TM-48 (Power of Attorney), and walk you through the documents you need to provide.

FILING & RECEIPT
The application is filed online through the Trade Marks Registry's portal. You receive the official filing receipt and application number — and may use the ™ symbol from this date.

Q Can I file the trademark myself? Is it worth involving a lawyer?
Legally, yes — you can file directly through ipindia.gov.in. Practically, the risk lies in errors that come up later. Incorrect class selection, weak descriptions of goods, or a mark that's deceptively similar to an existing one often results in objections that take months to resolve. A careful filing the first time tends to save substantial trouble down the road. Whether to engage a professional is your decision.
Q How do I know if my brand name is even available?
This is the most common starting point. Before any filing, we conduct a search of the Trade Marks Registry's public database, looking for identical and deceptively similar marks in your relevant class. The result tells us whether to proceed, modify the mark, or reconsider. The search itself is part of the initial work, not a separate paid service.
Q What if my application is objected? Is everything wasted?
No. Objections are routine — a significant share of trademark applications receive an examination report under Section 9 or Section 11. Most are responded to and resolved with a properly drafted reply within the 30-day window. We handle this without surprise charges; the scope of work is discussed upfront.
Q Do I need to be in Delhi to work with your office?
No. Our office is in Shakti Nagar, Delhi, and we welcome in-person consultations. But trademark applications are filed centrally with the Trade Marks Registry, regardless of the applicant's location. We work with clients across India — Mumbai, Bangalore, Hyderabad, Chennai, Pune, Kolkata, smaller cities — entirely over WhatsApp, email, and video call.
Q How long will the whole thing take?
The application is filed within a working day or two of receiving documents — at which point the ™ symbol may be used. The full registration certificate, allowing the ® symbol, typically takes 8 to 18 months, depending on the Registrar's examination queue and whether any objections or oppositions are raised.
Q What happens after registration? Is it permanent?
A registered trademark is valid for 10 years from the date of registration and can be renewed indefinitely for further 10-year periods. We handle renewals and remind clients in advance of expiry, as long as they are with us.
